Political Constitution of Costa Rica

Introduction

The Political Constitution of the Republic or also called the Fundamental Charter, in an order of hierarchy is the supreme law of our legal system. Being this law that has the highest hierarchy with respect to all the laws that we find in our legal system, all the rest of the laws that exist must be created in accordance with the Political Constitution of the Republic, that is, they should not contradict it.

Developing

The Political Constitution could be defined as a legal norm, because it governs and is imperative. Establishes limits and guarantees duties and rights of citizenship. It is considered as the highest authority of a country.

History of constitutionalism of Costa Rica

On November 7, 1949, the Political Constitution of Costa Rica began governing, which is in force until today. But it was an extensive process, where there were several constitutions:

Functions of the Political Constitution in the country:

  • All the laws of the country must respect the Magna Carta: any law that is to promulgate must respect what is written in the Constitution.
  • Provides order in the country: it could be said that it helps to form the conduct of society or citizens.
  • Establishes the duties and rights of citizens: in it all the duties and rights that the inhabitants of the country are written are written.
  • It establishes a division of powers in the country: forms the division between the Executive, Legislative and Judicial Power and thus does not concentrate on a single entity or in a single person.
