La vida es el valor esencial y debe ser protegida por el Estado con todos los medios posibles, pero no podemos dejar de lado la parte humana del tema y ser honestos al señalar que la muerte como un camino menos traumático y doloroso posible y esta alternativa ofrece la eutanasia, la cual difiere de ser un crimen, sus motivos son de misericordia tanto para el que sufre como para aquellos que lo rodean.

Lo que se desea es que el paciente tenga la opción de decidir o seguir en la lucha por seguir viviendo, mas no el que la muerte asistida sea el fin para cada persona que se encuentre en alguna etapa terminal.

  • El tema se trata de buscar la paz en la muerte, debe ser un tema tratado con respeto y dignidad, a pesar de enfermedades degenerativas, en ciertos casos que son los pacientes quienes tienen que llevar cuidados paliativos, no desean sobrevivir en tal estado y solo desean descansar.
  • Es necesario legislar una norma que contenga los debidos parámetros para los casos en los que se puede aplicar la Eutanasia, haciendo alusión a los términos con la manifestación de la voluntad expresa, siendo mayor de edad, de lo contrario se requerirá la autorización del tutor o curador del incapaz relativo o absoluto que solicite que se le conceda la Eutanasia, que haya certificados médicos de que el enfermo tiene un padecimiento físico o psicológico insuperable y también, que esta declaración prescriba a los cinco años de haberse manifestado.
  • La legislación de esta norma ayudaría a evitar sufrimientos innecesarios al paciente, tanto como a su familia, debido a que este es un proceso muy complicado para ambos, sabiendo que lo único que se hace es prolongar una vida de una manera no digna, que a la larga igual lo llevará al fallecimiento.
  • Es necesario recalcar que la eutanasia nunca debe ser entendida como un deber para ninguna de las partes involucradas. Como ya mencionamos, debe ser una elección individual y basada en el derecho a decidir sobre la propia vida. De igual manera, el debate democrático para su regulación debe enfocarse en argumentos jurídicos, políticos e incluso económicos. Por consiguiente, siendo un Estado laico el peruano, se deben excluir del debate objeciones de carácter religioso que brinden una connotación divina a la vida y le otorguen la naturaleza de irrenunciable. No se puede razonar con base en la fe o moral individual y pretender que sea de aplicación generalizada.
