Copyright Law: Creative Commons licenses

Introduction

In our daily lives as students we use and elaborate documents, essays and all kinds of content that require the use of texts by other authors. Creative Commons licenses are those that allow the authors to give the possibilities and power to choose how their work will be used, as well as choose the different combinations about a given work.

On the other hand, licenses are not related to moral rights since these rights do not allow themthe information they create convenient; What happens with these licenses is that it allows to distribute the information, as long as, there is a proper license and that it does not attempt against the Intellectual Property Law.

Source

Creative Commons licenses are an organization created by professors Lawrence Lessig, from Stanford University, and James Boyle, of the Duke Law School, inspired by Richard Stallman’s work and the work of the Free Software Foundation. Stallman created General Public License (GPL) in 1985 to dissemin. Regarding these programs, no authorization is required to access their “source code” or to modify it, obtain copy or use it for any purpose, it is also not subject to such authorization of the distribution of the modified programs or the realization of them of those mentioned.

The licenses have the idea of providing specific instruments to the creators who become legal instruments that allow the authors to establish the terms in which they want to share their works, letting others modify, reuse them or redistribute them, maintaining their recognition ascreators. The only activity that performs is to facilitate licenses to authors for the management of their works through the digital environment.

The content of the licenses balances the specific use of the contents of the rest of the world. that is, it seeks to promote the creative reuse of intellectual works, allowing the time that the creator maintains the rights he considers appropriate. (Marquez, 2008)

For this, Creative Commons makes available to the authors on their website forms that allow you to choose the characteristics with which the creator wants to distribute his work. A license generates three formats:

  • Authorized Use Summary
  • A legal text.
  • A digital version that can be used to facilitate the work of web search engines.

Licenses are partially inspired by those of free software, although it is very important to note that they have not been created for application to software programs.

Each of them offers a combination of the following characteristics:

  • Recognition. The Creator allows to copy, distribute and communicate the work publicly while adequately recognized and cit the original author.
  • No comercial. It is allowed to copy, distribute and communicate the work publicly as long as it is not used for commercial purposes.
  • Facilitates including the use, allowed and prohibited, with respect to a certain work have an indefinite, perpetual duration and, we could say, irrevocable.

This has a very clearse. The author is canceled the freedom of power, at any time, change the license for another or even cancel it.

Licenses are authentic public hiring offers "Online" what does them, not only being necessarily submitted to the Civil Code and the Services Law of the Information Society, but also to the regulations related to the general conditions of contracting.

According to the Law on General Conditions of Contracting (LCGC), the drafting of the general clauses must be adjusted to the criteria of transparency, clarity, concretion, and simplicity adding that those that are illegible, ambiguous, dark and incomprehensible, are not incorporated into the contract.unless the latter "have been expressly accepted in writing by the adherent and conform to the specific regulations that discipline in its field the necessary transparency of the clauses contained in the contract".

Since none of the forms contains any indication about the way in which the licensee will notify the author’s acceptance (not even electronically)-limiting himself to say that "by exercising any right over the work," you "(the licensee) accept and consent to the limitations and obligations of this license ”, we conclude that the author will only know the aforementioned acceptance when he finds out, that his work has been used and that the person responsible for that use is preciselyThe acceptor of his license. (Aliprandi, Google Books, 2013)

Conclusions

  • The organization provides more reliability to the authors regarding their works and great freedom to show all their contents without any concern.
  • In conclusion, these licenses are a very useful tool so that people who believe their own information can establish and have power over the uses they can give to their works.
